SMS Terms and Conditions

These SMS Terms & Conditions ("SMS Terms") are a binding agreement that governs the text-messaging program (the "Program") operated by the Miami-Dade Democratic Executive Committee ("MDDEC," the "Miami-Dade Democratic Party," "we," "us," or "our"). By opting in to the Program, or by sending any message to us through the Program, you agree to these SMS Terms and to our Privacy Policy at https://www.miamidadedems.org/privacy. If you do not agree, please do not opt in.

1. Program description

The Program serves as a voter help and information line and as a way for us to hear from the community. Through the Program, we send recurring automated text messages and respond to your replies with information about voting, vote-by-mail re-enrollment, ballot deadlines, voting locations, volunteer opportunities, and related election information, and we invite and receive feedback that you choose to share with our team and leadership.

2. Opt-in and consent

You can join the Program by providing your mobile telephone number and opting in — for example, by checking the consent box on our sign-up form and submitting it, or by giving affirmative consent to an authorized representative. By opting in, you consent to receive recurring automated text messages from MDDEC at the number you provide, including messages sent using automated technology.

Your consent to receive messages is not a condition of any purchase, service, registration, donation, or participation in any activity. You represent that you are at least 18 years old, that you are the subscriber or the customary user of the number you provide, and that you are authorized to enroll that number in the Program.

3. Message frequency

Message frequency varies, including based on election timing and on your own replies and interactions with us.

4. Cost

Message and data rates may apply in accordance with your mobile carrier plan. MDDEC does not charge a fee to participate in the Program, but your carrier's standard messaging and data rates apply to all messages sent and received. Please check your plan or contact your carrier for details.

5. How to opt out

You can cancel at any time by replying STOP to any message. Common opt-out keywords such as STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT are also recognized. After you opt out, you will receive one final confirmation message, after which no further Program messages will be sent unless you re-enroll. To re-subscribe, reply START or sign up again through our sign-up form.

7. Keeping your information current

You agree to provide accurate information and to notify us if your mobile telephone number changes, is deactivated, or is transferred to another person. If you give up or transfer a number you enrolled, you agree to opt that number out of the Program first. You are responsible for all messages associated with the number you provide.

8. Supported carriers and delivery

The Program is compatible with major U.S. wireless carriers. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier, may be affected by factors outside our control, and is not guaranteed.

9. Acceptable use

You agree to use the Program only for lawful purposes and not to send unlawful, harassing, abusive, or harmful content or to interfere with or disrupt the Program. We may suspend or remove any participant from the Program at any time and for any reason.

10. Privacy

Information collected through the Program is handled in accordance with our Privacy Policy, available at https://www.miamidadedems.org/privacy. We do not sell, rent, lease, or share mobile telephone numbers, SMS opt-in, or consent information with any third parties or affiliates for their own marketing or promotional purposes under any circumstances. We may share this information with service providers who help us operate the Program solely to deliver the service, under obligations of confidentiality, and only as necessary, and we may disclose it where required by law or to protect our legal rights.

11. Eligibility

The Program is intended for individuals who are at least 18 years old, who have a U.S. mobile telephone number, and who are able to provide valid consent.

12. Disclaimer and limitation of liability

The Program is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, MDDEC and its officers, volunteers, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or relating to your participation in the Program, including any delayed or undelivered messages or any charges imposed by your carrier.

13. Governing law

These SMS Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Program or these SMS Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

14. Changes to these terms

We may update these SMS Terms from time to time. Material changes will be reflected by a revised "Last updated" date above, and your continued participation in the Program after such changes constitutes acceptance of the updated SMS Terms.

15. Severability and entire agreement

If any provision of these SMS Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These SMS Terms, together with our Privacy Policy, constitute the entire agreement between you and MDDEC regarding the Program and supersede any prior agreements on that subject.
